Subjects dealt with 1) Issues under consideration: - Joint parental rights: the first text examined by this Committee dealt with parental authority. Law no. 1278 of 29 December 2003 was passed with a view to mainstreaming gender parity, even in the parent and spouse context, and thereby bringing to an end "paternal rights", and paving the way for "parental rights". - Transmission of nationality: this is a sensitive issue in the Principality, particularly taking into account its socio-geographical ramifications. However, improvements have been made, notably with the passage of law no. 1276 of 22 December 2003, recognizing in both men and women the right to transmit to their children nationality acquired by naturalization, thereby allowing women naturalized by the Sovereign Prince to pass down their nationality to their children. Similarly, law no. 1296 of 12 May 2005 allows children who have become citizens of Monaco by virtue of the so-called third-generation law that was in force between 1952 and 1959, also to transmit their nationality to their children. - Adoption leave: Law No. 1271 of 3 July 2003 on adoption leave granted to working persons introduced the notion of possible parental leave, for private-sector employees, of between 8 and 10 weeks, depending on whether one or more children are adopted. 2) Ongoing projects: - Paternity and adoption leave: in the interest of gender parity, the Committee drafted and submitted a proposal on paternity leave for private-sector employees as well as two other Bills on paternity and adoption leave for public servants (government and communal officials). Laws Nos. 1309 and 1311 of 29 May 2006 henceforth allow fathers to take legal paternity leave at the birth or adoption of one or more children. - Remodelling the law on divorce: previously, the Principality only recognized divorce on fault grounds. The Committee wishes to modernize the text, introduce the possibility of consensual divorce and divorce due to separation, and, in general terms, facilitate formalities. This is the purpose of Law No. 1336 of 12 July 2007. Projects under way: Combating domestic violence: Private bill no. 190 on combating domestic violence was adopted in a public sitting on 29 April 2008. In October of the same year, the government announced its intention to soon make it into a bill. Medical abortions: Medical abortions concern women who have been raped or who are victims of incest or who carry an embryo with a major and irreversible handicap. The Committee submitted private bill No. 187 to the National Council on 28 September 2006, which was adopted in a public sitting on 10 October 2006. As the government subsequently interrupted the process, on 3 April 2007, in a public sitting, given the delicate nature of the subject, a joint working group comprising members of the National Council and the government was set up to finalize a bill, which should be submitted soon.
